
John Dyrud, Partner, and Harry Wiggin, Consultant, lawyers at Anguilla law firm Webster Dyrud Mitchell, have played a leading role in the development and drafting of the Anguilla Private Foundation Act, which will broaden the appeal of Anguilla for a whole new category of financial services clients. This legislation is expected to be enacted in the near future.
The Act will enable Anguilla to offer the civil law private foundation concept as an alternative to the existing common law trust available in Anguilla, while providing a high level of protection in terms of anti-forced heirship rules and rules overriding foreign laws and judgments. It will also have the unique advantage, compared with similar legislation in other jurisdictions, of permitting enforcement under an almost infinite variety of procedural and/or geographic regimes.
This user friendly legislation will keep Anguilla at the forefront in this field.
